Welcome to registry.donatelifela.org. (“Site”). This Site is owned and operated by the Louisiana Organ Procurement Agency (hereinafter referred to as "us", "we", "our", or "LOPA"). By accessing and using this Site you agree to accept and be bound by the terms and conditions of use set forth below (“Terms and Conditions”).

The purpose of this Site is to provide a donor registry for residents and individuals residing in the state of Louisiana who wish to register as an organ, eye and tissue donor for purposes of transplant, therapy, research or education, by making a document of gift, as described in the Louisiana Uniform Anatomical Gift Act , La. R.S. 17:2351, et seq. The registry is a database of documents of gifts and any amendments to or revocations thereof, that may be accessed by LOPA and eye recovery organizations in this state after a donor’s death so that the donor’s decisions regarding organ, eye and tissue donation can be honored.

To register your document of gift, complete and submit the donor registry form. You will be asked to provide certain personally identifiable information (“personal information”). You agree to provide current, complete and accurate information at the time you register. Once you submit your donor registration form, you will receive an email with instructions on how to create a user account and password, which you may subsequently use to view, amend or revoke your document of gift.

II. Ownership and Limited Use of Site

All material and content accessible from or displayed on this Site (hereinafter referred to as the “Content”) are protected by copyright laws of the United States and international copyright law. All rights are reserved. The Content accessible from this Site is owned, operated, licensed and/or controlled by LOPA, is the proprietary information of LOPA, and LOPA retains all right, title and interest in the Content, which may not be used except as provided in these Terms and Conditions.

You may view, print and/or download one copy of the Content on any single computer solely for your personal, informational, non-commercial use, provided you keep intact all copyright and other proprietary notices and make no modifications to any Content. Except as noted above, you may not copy, reproduce, modify, publish, republish, upload, post, transmit, display, reuse, report or distribute in any form or by any means any Content on or from this Site for any other purpose, including any commercial purpose, without LOPA's express prior written consent. The use of any such Content on any other website or networked computer environment or for any other purpose is prohibited and may violate copyright, trademark, intellectual property and other similar laws.

III. User Conduct

You may use this Site solely for the purposes expressly permitted in these Terms and Conditions. You agree to use this Site only for lawful purposes. You agree not to take any action that might compromise the security of the Site, render the Site inaccessible to others or otherwise cause damage to the Site or the Content. You agree not to add to, subtract from, or otherwise modify the Content, or to attempt to access any Content that is not intended for you. You agree not to use the Site in any manner that might interfere with the rights of third parties.

You agree to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the Site. You agree to comply with all applicable laws, statutes, ordinances and regulations regarding the transmission of data / other Information. "Information" is defined as any information or other Content you provide (directly or indirectly) to LOPA, including through the registration process or email.

Access and use of password protected or secured areas of this Site are restricted to authorized users only. LOPA is not liable or responsible for monitoring or confirming the accuracy of any information supplied by you or any error or violation of any laws or regulations by you. It is a violation of the Terms and Conditions to: provide false personal information to create a user account; create a user account for anyone other than yourself without lawful authority; or do anything that might jeopardize the security of your account. You are solely responsible for maintaining the confidentiality of any user account and password that you choose, as well as any activity that occurs under your user account/password. You are solely responsible for any unauthorized use of your user account and password and shall not misuse your user account or password, misrepresent your identity, impersonate any person or entity or misstate the origin of any Content you are exposed to through this Site.

You are solely responsible for your communications and their legality. You agree not to use this site to distribute, link to or solicit content that is defamatory, harassing, unlawful, libelous, harmful to minors, threatening, obscene, false, misleading, or infringing a third party intellectual or privacy rights, or engage in any other unacceptable use of the Site of whatsoever nature or means. Except for disclosure by you of personal information as specified herein and in our Privacy Policy, or for technical support purposes, all communications from you to this Site will be considered non-confidential and non-proprietary.

We have the right, in our sole discretion, to suspend or terminate your use of our Site and refuse any and all current or future use of all or any portion of our Site.

Any copyrights in the Content are owned by LOPA. You agree to comply with copyright laws in your use of this Site, and you agree that you will not modify, copy, distribute, transmit, display, reproduce, republish, license, create derivative works from, transfer, or sell any Content obtained from this Site, in whole or in part, without the express prior written permission of LOPA. Except as provided herein, you may not print, download or copy Content from this Site.

You may not manipulate or alter Content on the Site in any way. You may not remove or alter any copyright, trademark or other proprietary notice appearing on any of the Content. Modification or use of the Content except as expressly provided herein violates LOPA's intellectual property rights. Neither title to nor right to use any intellectual property rights are transferred to you by access to this Site.

IF YOU ARE DISSATISFIED WITH THE SITE, THE CONTENT, OR WITH THE TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

XI. Indemnification

You agree to indemnify, defend and hold harmless LOPA, and all of its officers, directors, members, employees, agents, contractors, affiliates, business partners, and third-party providers to the Site from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys' fees, resulting from or arising out of your access, use, misuse, or inability to use the Site or the Content, or any violation by you of these Terms and Conditions.

XII. Termination

These Terms and Conditions are effective until and unless terminated by LOPA at any time in its sole discretion without prior notice. In the event of termination, the disclaimers, limitation of liability and indemnification set forth in these Terms and Conditions shall survive.

XIII. General Provisions

Entire Agreement/No Waiver. These Terms and Conditions constitute the entire agreement of the parties with respect to the subject matter hereof. This version of the Terms and Conditions supersedes any earlier versions. If any provision of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.

Modification. LOPA shall have the right, at its discretion, to change, update, modify, add or remove the Terms and Conditions at any time at its sole discretion without prior notice. Changes shall be effective immediately. The last date these Terms and Conditions were revised is set forth below.

Correction of Errors and Inaccuracies. The Site may contain typographical errors or other errors or inaccuracies and may not be complete or current. LOPA therefore reserves the right to correct any errors, inaccuracies or omissions at any time without prior notice. We do not, however, guarantee that any errors, inaccuracies or omissions will be corrected.

Choice of Law/Choice of Forum. Any and all claims, actions or disputes relating to the Content, Terms and Conditions, Privacy Policy and use of this Site, and any other web site owned or operated by LOPA, shall be governed by and interpreted in accordance with the laws of the State of Louisiana, disregarding any choice-of-law principle which may be applicable under the laws of another jurisdiction and you expressly agree to submit to the exclusive personal jurisdiction of the Twenty-Second Judicial District Court, for the Parish of St. Tammany, State of Louisiana, or the United States District Court for the Eastern District of Louisiana.

Headings. The headings are provided for convenience purposes only and shall not be used to interpret these Terms and Conditions.
